ECONOMICS VIDEO HANDBOOKS WEBSITE TERMS OF USE AGREEMENT
The Economics Video Handbooks website at Internet address econvideos.ucsd.edu (hereinafter, “Site”) comprises user interfaces and educational content including several “Video Handbooks”. Each Video Handbook consists of an individual website and a set of video lectures (collectively, “Handbook Content”). The Site and all Handbook Content are owned, in parts, by Joel Watson (Professor, University of California, San Diego), Melissa Famulari (Teaching Professor, University of California, San Diego), and the following parties, each who is or was at one time a faculty member at the University of California, San Diego: Brendan K. Beare, Eli Berman, Julie Berry Cullen, Gordon B. Dahl, Graham Elliott, Simone Galperti, Mark J. Machina, Paul Niehaus, Yixiao Sun, and Kaspar Wuthrich. These named parties own the copyright to the Site and all Handbook Content.
This Terms-Of-Use Agreement (“Agreement”) governs your usage of the Site and your viewing of Handbook Content. To access the Site and to view Handbook Content, you must consent to this Agreement in its entirety. By creating an account on the Site, you acknowledge your consent to this Agreement. If you do not consent, do not create an account. Account holders are hereinafter referred to as “Users” and “You”. The Site owners are referred to, collectively, as “We” and “Us”.
The purpose of the Site is to provide Handbook Content to registered Users, mainly students, under the restrictive terms described in this Agreement.
CONTENT, ALLOWED USE, AND DISCLAIMER
The Site and all Handbook Content are provided to approved and verified Users under a limited license that allows them to view Handbook Content on the Site for a specified period of time. When You are approved for, and given access to, a Video Handbook, You are allowed to view the video lectures contained in the Video Handbook only in streaming form as delivered on the Site. You are not allowed to download the videos, record any video stream, or copy any Handbook Content from the Site. You are not allowed to alter, redistribute, or create any derivative content.
The Site and all Handbook Content are provided “as is”, with no warranty. Although We aim to provide reliable access, We do not guarantee that the Site will be maintained or available without interruption. You acknowledge that the Site may become inoperable or be discontinued at any time, and Handbook Content may be withdrawn or changed by Us without notice. The University of California, San Diego is not responsible for the Site and Handbook Content, except insofar as expressed in the ILTI Implementing Agreements that governed the development of some of the Handbook Content.
We operate the Site on a volunteer basis, without any dedicated source of funding. Thus, we offer no user support for the Site and Handbook Content. We make no representation as to the results to be obtained from your use of the Site and Handbook Contents. We do not provide any support for persons with disabilities, other than closed captioning and our attempt to exercise best practices for video presentations and editing.

FEES
As detailed in our Privacy Notice, if You are required to pay a fee for products or Services made available at the Site or wish to make a voluntary payment (donation), and if you elect to make the payment by credit card, then payment processing shall be administered by an outside credit-card processing service provider such as Stripe. In addition to providing us with information as to your name and an indication of the use fee or donation for which you will be submitting payment, you may be asked by the applicable service provider to supply other information, including but not limited to credit card information, in order to complete the payment. You agree that all information that you provide to us or any such service provider will be accurate, complete and current. You agree to promptly pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. Moreover, you agree to review and to comply with the terms and conditions of any specific agreement, if any, that you enter into with the outside credit-card processing service provider in connection with the licensing or purchase of any product or service.
LIMITATION OF LIABILITY
You agree that We are not responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive, or other damages under any contract, negligence, strict liability, or other theory arising out of or relating in any way to the Site and/or Handbook Content. Your sole remedy for dissatisfaction with the Site and/or Handbook Content is to stop using the Site. The sole and exclusive maximum liability to Us for all damages, losses, and causes of action (whether in contract, tort, including, without limitation, negligence or otherwise) shall be the total monetary amount paid by You, if any, to access Handbook content during the period of time in question.
VOID WHERE PROHIBITED
Although the Site is accessible worldwide, not all products or services discussed, referenced or made available on the Site may be available to all persons or in all geographic locations or jurisdictions. We make no representation that materials in the Site are appropriate or available for use in all locations. All Users are responsible for compliance with local laws if and to the extent local laws are applicable. We reserve the right to limit the availability of the Site and/or the provision of any product or service described thereon to any person, geographic area, or jurisdiction We so desire at any time and in our sole discretion and to limit the quantities of any such product or service that we provide.
INDEMNIFICATION
You agree to indemnify, defend and hold Us, our affiliates, sponsors, officers, directors, employees, agents, representatives and suppliers harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, (b) your violation of your rights and obligations under this Agreement, and/or (c) your activities in connection with the Site.
RIGHTS OF OWNERSHIP
The Site, including all pages within, all videos, and all code related thereto, and all trademarks, service marks, trade names, trade dress and other intellectual property rights in the SIte are owned by Us. No portion of the materials or code on these pages or anywhere on the Site may be reprinted or republished (other than as is necessary to view the page on your monitor) in any form without our express written permission. The Site is owned and operated by Us in conjunction with others pursuant to contractual arrangements. Unauthorized use of the materials on the Site may violate copyright, trademark, patent and other laws and is prohibited.
TERMINATION
You may terminate the Agreement, for any or no cause, at any time, with notice to Us which shall be effective upon our processing of such notice and suspension of your account. We, in our sole discretion, may terminate the Agreement for any or no cause, at any time, with or without notice, which shall be effective immediately or as may be specified in the notice. Termination of your account includes disabling your access to the Site and Handbook Content and may also bar you from any future use of the Site.
In furtherance and without limiting the foregoing, We have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, Users who are deemed to be infringers under the United States Copyright Act. We may also at our sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
CHILDREN
The SIte is not intended for children under 18 years of age. Children under the age of 18 are not eligible to register for user accounts. We do not knowingly collect personal information from children under 18.
CHOICE OF FORUM
You agree that any action at law or in equity arising out of or relating to these terms or the Site shall be filed, and that venue properly lies, only in the state or federal courts located in the County of San Diego, State of California, United States of America and you consent and submit to the personal jurisdiction of such courts for the purposes of litigating such action.
CHOICE OF LAW
This Agreement is entered into in the State of California and shall be governed by and construed in accordance with the laws of the State of California, exclusive of its choice of law rules. Each party to this Agreement hereby submits to the exclusive jurisdiction of the state and federal courts sitting in the County of San Diego in the State of California for any dispute arising under or in connection with this Agreement, the Site or any Site-related Services, and waives any jurisdictional, venue or inconvenient forum objections to such courts. In any action to enforce this Agreement,
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof, is entered into freely and voluntarily with full knowledge and understanding of the contents thereof, and any and all written or oral agreements heretofore existing between the parties hereto are expressly canceled.
